This document sets out the terms and conditions governing the use of the online store shop.annakara.com and the conclusion and performance of contracts for the sale of Products through the Store. §1 GENERAL INFORMATION
- These Terms & Conditions ("Terms") govern:
- the use of the online store available at shop.annakara.com ("Store");
- the conclusion and performance of distance sales contracts for Products offered through the Store;
- the rights and obligations of Customers and the Seller.

- These Terms apply to Customers purchasing Products through the Store.
- Nothing in these Terms excludes or limits mandatory consumer rights granted under applicable law.
§2 DEFINITIONS
For the purposes of these Terms:
Account means a customer account maintained within the Store.
Business Day means Monday through Friday excluding public holidays in Poland.
Consumer means a natural person acting for purposes outside their trade, business, craft or profession.
Customer means any person placing an Order through the Store.
Contract means a distance sales contract concluded between the Seller and the Customer.
Order means the Customer's declaration of intent to purchase Products through the Store.
Privileged Entrepreneur means a natural person acting in connection with a business activity that is not professional in nature.
Product means any item offered for sale through the Store.
Seller means Anna Kara as identified in §1.
Store means shop.annakara.com.

§4 TECHNICAL REQUIREMENTS
To use the Store, the Customer must have:
- internet access;
- a device capable of accessing websites;
- a modern web browser supporting cookies and JavaScript;
- an active e-mail address.
The Seller does not guarantee uninterrupted operation of third-party networks or internet service providers.
§5 PRODUCTS
- The Store offers clothing products and related fashion items.
- Product photographs, descriptions and visual representations are intended to present Products as accurately as possible.
- Minor differences resulting from display settings, screen calibration or photographic presentation do not constitute a lack of conformity.
- Product availability is subject to stock and operational capacity.
§6 PURCHASES IN THE STORE
- Orders may be placed 24 hours a day.
- Before placing an Order, the Customer receives information concerning:
- Products selected;
- delivery method;
- payment method;
- total price;
- delivery costs.
The Customer places an Order by:
- adding Products to the shopping cart;
- completing the checkout form;
- accepting these Terms;
- confirming the Order.
Each Order constitutes a separate Contract. The Contract is concluded when the Seller accepts the Order.
§7 PRICES AND PAYMENTS
- All prices displayed in the Store include applicable taxes unless expressly stated otherwise.
- Available payment methods are displayed during checkout.
- The Seller may use third-party payment service providers.
- Payment providers may apply their own terms and conditions.
- The Customer is responsible for ensuring payment information is accurate.
- Electronic invoices may be issued where permitted by law.
§8 ORDER PROCESSING
- The estimated processing time for an Order is up to 14 Business Days unless otherwise stated on the relevant Product page.
- Processing times may vary depending on Product availability, operational circumstances or periods of increased demand.
- Processing time begins once payment has been successfully received and verified.
- Processing time does not include delivery time.
- If exceptional circumstances arise that may significantly affect processing times, the Seller may inform the Customer of the updated estimated processing time.
§9 DELIVERY
- Current delivery destinations are displayed on the Store website.
- Available delivery methods are displayed during checkout.
- Delivery costs are displayed during checkout before the Order is placed.
- The Seller may use third-party logistics providers, courier companies and postal operators to fulfil deliveries.
- Risk of loss or damage passes to the Consumer when the Product is physically received by the Consumer or a person designated by the Consumer, other than the carrier.
- Customers should inspect delivered parcels without undue delay and, where possible, report visible transport damage directly to the carrier.
§10 RIGHT OF WITHDRAWAL
- Consumers and Privileged Entrepreneurs may withdraw from the Contract within 14 days without giving any reason.
- The withdrawal period expires 14 days after receipt of the Product.
- To exercise the right of withdrawal, the Customer must send:
- a completed Withdrawal Form; or
- an unequivocal statement
to:
- The withdrawal notice must be sent before expiry of the withdrawal period.
- Following withdrawal, the Product must be returned within 14 days.
§11 EFFECTS OF WITHDRAWAL
- Upon valid withdrawal, the Seller shall reimburse all payments received from the Customer.
- Refunds include:
- the Product price;
- the cost of the least expensive standard delivery option offered by the Store.
Refunds will be made using the original payment method unless otherwise agreed.
- The Seller may withhold reimbursement until the returned Product has been received or until the Customer has supplied evidence of having sent back the Product, whichever occurs first, in accordance with applicable law.
- The Seller reserves the right to inspect the returned Product upon receipt in order to assess whether the Product has been handled beyond what is necessary to establish its nature, characteristics and functioning.
- Where the returned Product shows signs of use, damage, alteration, missing components or handling exceeding what is necessary to establish its nature, characteristics and functioning, the Seller may reduce the amount of reimbursement to reflect the diminished value of the Product, as permitted by applicable law.
§12 RETURNS
- Customers bear the direct cost of returning Products.
- Upon request, the Seller may provide a prepaid return label.
- Where the Seller provides such label, its cost may be deducted from the refund amount.
- Returned Products should be properly packaged to prevent damage during transit.
- Customers should return Products in an appropriate condition, together with all accessories, tags, packaging and other elements originally supplied with the Product where reasonably possible.
- The absence of original packaging shall not in itself prevent the exercise of the right of withdrawal, but the Customer remains responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.
§13 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to:
- Products manufactured according to the Customer's individual specifications;
- Products clearly personalised for the Customer;
- Products modified at the Customer's request, including but not limited to:
- custom length adjustments;
- structural alterations;
- bespoke modifications.
§14 COMPLAINT PROCEDURE
- Complaints may be submitted by e-mail to shop@annakara.com.
- Complaints should contain:
- Customer name;
- Order number;
- description of the defect or lack of conformity;
- photographs where reasonably available;
- preferred remedy.
- The Seller may request additional information necessary to assess the complaint.
- Failure to provide supporting information shall not automatically invalidate the complaint.
- The Seller shall acknowledge receipt of the complaint without undue delay.
- A substantive response shall be provided within 14 days after receiving all information reasonably necessary for assessment.
§15 LEGAL GUARANTEE OF CONFORMITY
- The Seller shall be liable for any lack of conformity existing at the time of delivery and becoming apparent within the period provided by applicable consumer protection laws.
- A Product shall be considered in conformity where it:
- corresponds to the description provided by the Seller;
- possesses the qualities and characteristics presented before conclusion of the Contract;
- is fit for the purposes for which goods of the same type are normally used;
- is supplied with accessories, packaging and instructions reasonably expected by the Customer;
- meets durability, functionality and safety standards reasonably expected for goods of the same type.
- Consumers shall not lose any statutory rights because they choose to exercise a contractual remedy offered by the Seller.
- The Seller remains liable for mandatory legal guarantees provided under applicable law.
§16 REMEDIES FOR LACK OF CONFORMITY
- Where a Product lacks conformity, the Consumer may request:
- repair;
- replacement;
- proportionate price reduction;
- termination of the Contract.
- Repair or replacement shall be carried out free of charge.
- Repair or replacement shall be completed within a reasonable time and without significant inconvenience.
- The Consumer may request a price reduction or terminate the Contract where:
- repair or replacement is impossible;
- repair or replacement has not been completed within a reasonable time;
- lack of conformity persists despite repair or replacement;
- the lack of conformity is sufficiently serious.
- Termination shall not be available where the lack of conformity is minor.
§17 USER ACCOUNTS
- Customers may create an Account free of charge.
- Accounts provide access to:
- order history;
- order status information;
- account management functions.
- Customers are responsible for safeguarding login credentials.
§18 NEWSLETTER
- Customers may voluntarily subscribe to receive marketing communications.
- Marketing communications may concern:
- products;
- promotions;
- collections;
- events.
- Subscription may be cancelled at any time.
§19 PRODUCT SAFETY (GPSR)
- The Seller complies with Regulation (EU) 2023/988 on General Product Safety.
- Product pages may contain:
- composition details;
- care instructions;
- safety information.
Product safety concerns may be reported to:
- The Seller may take corrective actions including recalls where required by law.
- The Seller may investigate any reported safety concern and may contact Customers for additional information.
- Where required by law or reasonably necessary to protect Consumers, the Seller may:
- suspend sales of a Product;
- publish safety warnings;
- implement corrective actions;
- organise product recalls;
- notify competent authorities. - Customers should:
- follow care instructions;
- use Products in a foreseeable and intended manner;
- report safety concerns without undue delay;
- cease using Products where instructed by the Seller.

For all product safety matters, including reports of accidents, injuries, defects, hazards or safety concerns relating to Products purchased through the Store, Customers may contact:

§21 FRAUD PREVENTION
The Seller reserves the right to refuse, suspend or cancel Orders where there are reasonable grounds to suspect:
- fraud;
- payment abuse;
- identity theft;
- unauthorised transactions;
- obvious pricing errors.
§22 DIGITAL SERVICES ACT (DSA)
- Notices concerning allegedly illegal content may be submitted to:
- The notice should contain sufficient information to identify the content concerned.
- The Seller may remove or restrict access to content where required by applicable law.
- The Seller may:
- investigate notices;
- request additional information;
- preserve evidence;
- cooperate with competent authorities. - The Seller may reject notices that are manifestly unfounded, abusive or insufficiently substantiated.
- Nothing in this section shall require the Seller to undertake a general obligation to monitor content.
§23 PERSONAL DATA
- Personal data is processed in accordance with:
- Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR);
- the Privacy Policy;
- applicable legal obligations.
Personal data may be processed for the purposes of:
- order fulfilment;
- payment processing;
- delivery of Products;
- customer service;
- handling complaints and returns;
- compliance with legal and accounting obligations;
- fraud prevention;
- product safety compliance.
Detailed information regarding the processing of personal data, including the categories of personal data processed, legal bases for processing, data retention periods and the rights of data subjects, is available in the Privacy Policy. The Privacy Policy forms an integral part of the information provided to Customers regarding the processing of personal data.
§24 INTELLECTUAL PROPERTY
All content available through the Store, including photographs, graphics, trademarks, product descriptions and designs, is protected by intellectual property laws.
No rights are transferred except as expressly required by law.
§25 BUSINESS CUSTOMERS
- Unless mandatory law provides otherwise, provisions concerning Consumers shall not apply to Customers acting exclusively in the course of business.
2. Business Customers shall inspect Products without undue delay following delivery.
3. Any defects or irregularities should be reported promptly after discovery.
4. To the maximum extent permitted by law, the Seller's liability towards Business Customers shall be limited to the value of the relevant Order.
5. The Seller shall not be liable to Business Customers for:
- loss of profits;
- indirect damages;
- consequential losses;
- loss of business opportunities;
- interruption of business activities.
§26 OUT-OF-COURT DISPUTE RESOLUTION
Consumers may seek assistance through:
- ECC-Net;
- national consumer authorities;
- mediation or dispute resolution bodies available under applicable law.
The Seller is not obliged to participate in arbitration proceedings unless legally required.
§27 LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
To the maximum extent permitted by law, the Seller shall not be liable for:
- indirect damages;
- consequential losses;
- loss of profits;
- loss of revenue;
- loss of business opportunities;
- business interruption.
This limitation shall not apply to Consumers where prohibited by mandatory law.
§28 APPLICABLE LAW
These Terms are governed by Polish law.
Mandatory consumer protection provisions applicable in the Customer's country of residence remain unaffected.
§29 LANGUAGE VERSIONS
Contracts are concluded in English.
Translations into other languages may be provided for convenience only.
In the event of any inconsistency, the English version shall prevail.
§30 FORCE MAJEURE
The Seller shall not be liable for delays or failures resulting from events beyond reasonable control, including:
- natural disasters;
- fires;
- floods;
- epidemics;
- pandemics;
- war;
- terrorist acts;
- strikes;
- transport disruptions;
- cyberattacks;
- governmental restrictions.
Performance of obligations may be suspended for the duration of such event.
The Seller shall make reasonable efforts to minimise the effects of such circumstances.
§31 FINAL PROVISIONS
- The Seller may amend these Terms to reflect changes in:
- applicable law;
- Store functionality;
- technological developments;
- business operations.
Amendments shall not affect Contracts concluded before the effective date of the amendment. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between the Seller and the Customer concerning purchases made through the Store.

- In the event of any inconsistency regarding purchases made through the Store, the Terms & Conditions shall prevail.
§2 DEFINITIONS
For the purposes of these Account Terms:
Account means an individual customer account maintained within the Store.
Customer means a person who has created an Account.
Store means the online store available at shop.annakara.com.
User means any person using the Account functionality.
§3 ACCOUNT CREATION
- Creating an Account is voluntary and free of charge.
- An Account may be created by completing the registration form available on the Store website.
- The User shall provide accurate, complete and up-to-date information during registration.
- The Seller may refuse registration where:

- false or misleading information is provided;
- registration would violate applicable law.

- use Accounts for unlawful purposes;
- interfere with the operation of the Store;
- attempt to gain unauthorised access to systems or data;

- violate applicable law or the rights of third parties.
The Seller may suspend or terminate an Account where these Account Terms are violated.
§7 ACCOUNT SUSPENSION AND TERMINATION
- The Seller may suspend or terminate an Account where:
- these Account Terms are breached;
- fraudulent activity is suspected;
- unlawful activity is detected;
- the Account is used in a manner that threatens the security or operation of the Store.
- Where reasonably possible, the Seller shall inform the User of the reasons for suspension or termination.
- Suspension or termination of an Account shall not affect rights and obligations arising from Contracts concluded before such suspension or termination.
§8 ACCOUNT DELETION
- Users may request deletion of their Account at any time by contacting:
- The Seller shall delete the Account without undue delay unless retention of certain information is required by law or necessary for the establishment, exercise or defence of legal claims.
- Deletion of an Account does not automatically cancel Orders already placed.
